1. The Service

Opinome.ai lets you build synthetic (AI-generated) audiences, publish draft social media posts to them and receive scores, a comparison of up to five versions and written commentary before you post anything publicly.

The Service does not connect to your social media accounts and does not publish anything on your behalf. All output is produced by large language models and is a directional, explainable signal — not a measurement of real-world performance.

2. Accounts

You need an account to use the Service. You may register with an email address and password or with Google sign-in. You must be at least 18 years old, or the age of majority in your country, and you must provide accurate registration details.

You are responsible for keeping your credentials confidential and for all activity performed under your account. Tell us at info@opinome.ai if you suspect unauthorised access.

3. Credits

The Service is paid for with credits, a prepaid virtual unit used inside the application. 100 credits cost USD 1.00. Credits are not money, cannot be transferred between accounts and cannot be exchanged back into currency.

New accounts receive 500 credits free of charge. This starting allowance is a promotional benefit, has no cash value and may be changed for future registrations.

Credits are consumed when you use AI-backed features such as generating an audience, enriching audience members, running a post test or generating commentary. The credit price of each task is shown before you confirm it and may be adjusted over time to reflect our costs.

Credits do not expire while your account is active. Credits already consumed are non-refundable.

4. Payments

Credit top-ups are processed by Stripe. We do not receive or store your full card details. Prices are shown in US dollars and include applicable taxes where required; your bank may apply conversion fees.

A purchase is complete when Stripe confirms the payment and the credits appear on your balance. If a payment is confirmed but credits do not appear, contact us and we will reconcile it.

5. Right of withdrawal (EU consumers)

If you are a consumer resident in the European Union, you normally have 14 days to withdraw from a distance contract. By purchasing credits and using them you ask us to begin performance immediately and acknowledge that you lose the right of withdrawal for credits already consumed.

Unused credits purchased within the last 14 days can be refunded on request to info@opinome.ai; we refund the proportional amount to the original payment method.

6. Acceptable use

You agree not to use the Service to:

• upload or test content that is unlawful, defamatory, hateful, sexually explicit involving minors, or that incites violence;
• infringe someone else's intellectual property, privacy or publicity rights;
• impersonate a real, identifiable person when describing a persona or audience;
• attempt to reverse engineer, scrape, overload or circumvent limits of the Service;
• resell raw model access or use the Service to build a competing model-routing product.

7. Your content

You keep all rights to the posts, images, personas and audience descriptions you upload. You grant us a limited licence to store and process them, and to transmit them to our AI providers, solely in order to run the Service for you.

We do not use your content to train our own models. Your content is private to your account and is not published or shown to other users.

You are responsible for having the rights to any material you upload, including images.

8. AI output

Scores, reactions, winners and commentary are generated by AI models reacting to a synthetic audience. They are estimates. They do not predict, promise or guarantee reach, engagement, revenue or any other real-world result.

You remain solely responsible for what you publish. Always apply your own judgement before acting on a result.

9. Availability and warranties

We work to keep the Service available, but it is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or that any particular AI model will remain available. We may change, suspend or discontinue features.

10. Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

We are not liable for indirect or consequential loss, lost profits, lost opportunities or reputational harm. Nothing in these Terms limits liability that cannot be limited by law, including consumer rights under Polish law.

11. Termination

You may stop using the Service and delete your account at any time by writing to info@opinome.ai. We may suspend or terminate an account that breaches these Terms or applicable law.

On termination, unused credits are forfeited unless the termination is our fault, in which case we refund their monetary value.

12. Changes to these Terms

We may update these Terms. Material changes will be announced in the application or by email at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by Polish law. Disputes are subject to the courts competent for the seat of Konri Software in Kraków, except where mandatory consumer rules give a consumer the right to a different court.

Consumers in the EU may also use the online dispute resolution platform at https://ec.europa.eu/consumers/odr.
